By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Platform.

The Platform allows users to:

  • Post and browse job opportunities
  • Create professional profiles
  • Submit applications
  • Share portfolios and related materials
  • Connect professionally within the industry

Fresh Cut Talent provides a platform for professional connections but is not an employer, staffing agency, recruiting firm, or employment agency unless expressly stated otherwise.

3. Account Registration

Certain features of the Platform require account creation.

You agree to:

  • Provide accurate, current, and complete information
  • Maintain the confidentiality of your login credentials
  • Promptly update inaccurate information
  • Accept responsibility for all activity conducted under your account
  • Notify us immediately of any unauthorized use of your account

Fresh Cut Talent reserves the right to suspend or terminate accounts that violate these Terms.

4. Job Listings

Employers may post job opportunities on the Platform.

Employers agree that all job postings:

  • Are accurate and lawful
  • Represent genuine employment opportunities
  • Comply with applicable employment laws
  • Do not contain misleading, discriminatory, or fraudulent information

Fresh Cut Talent reserves the right to edit, reject, suspend, or remove any posting that violates these Terms.

5. Job Applications

Job seekers are responsible for the accuracy of all application materials, including resumes, portfolios, cover letters, and professional information.

Fresh Cut Talent:

  • Does not guarantee employment
  • Does not guarantee interviews or candidate placement
  • Does not guarantee applicant quality
  • Does not verify every employer, candidate, or job posting
  • Does not guarantee hiring outcomes

Users are solely responsible for:

  • Evaluating opportunities
  • Verifying information
  • Conducting interviews
  • Negotiating compensation and employment terms
  • Performing appropriate due diligence

We encourage all users to exercise professional judgment and caution when interacting through the Platform.

6. User Content

Users may upload, submit, publish, or share content including:

  • Resumes
  • Portfolios
  • Cover letters
  • Job listings
  • Business profiles
  • Images
  • Professional profiles
  • Comments and communications
  • Other materials ("User Content")

You retain ownership of your User Content.

By submitting User Content, you grant Fresh Cut Talent a worldwide, non-exclusive, royalty-free license to host, display, reproduce, distribute, modify, and use such content for the operation, promotion, and improvement of the Platform.

You represent and warrant that:

  • You own or have permission to use the content you submit
  • Your content does not infringe upon the rights of others
  • Your content complies with applicable laws
  • Your content is accurate and not misleading

7. Payments and Paid Services

Certain features of the Platform may require payment, including but not limited to:

  • Job postings
  • Featured listings
  • Employer subscriptions
  • Promotional services
  • Premium features

By purchasing paid services, you agree to provide valid payment information and pay all applicable fees.

Unless otherwise stated, all fees are non-refundable.

Fresh Cut Talent reserves the right to modify pricing, subscription plans, features, or services at any time.

8. Prohibited Activities

Users may not:

  • Post false, misleading, or fraudulent information
  • Post fake job opportunities
  • Impersonate another individual or business
  • Upload unlawful, defamatory, discriminatory, harmful, or offensive content
  • Harass, threaten, intimidate, or exploit other users
  • Distribute spam or unsolicited communications
  • Upload malicious code or harmful software
  • Scrape, harvest, copy, or collect Platform data without authorization
  • Use bots, crawlers, spiders, or automated systems to access the Platform
  • Attempt unauthorized access to accounts, systems, or data
  • Interfere with Platform functionality or security
  • Violate applicable laws or regulations

Fresh Cut Talent reserves the right to suspend, remove, or terminate users who engage in prohibited conduct.

9. Intellectual Property

All Platform content, branding, logos, graphics, designs, software, text, and materials created by Fresh Cut Talent are owned by Fresh Cut Talent and protected by intellectual property laws.

Users may not reproduce, distribute, modify, publish, sell, or create derivative works from Platform materials without prior written permission.

10. Third-Party Links and Services

The Platform may contain links to third-party websites, social media platforms, portfolio services, payment processors, or other external services.

Fresh Cut Talent is not responsible for:

  • Third-party content
  • Privacy practices
  • Security measures
  • Transactions
  • Products or services provided by third parties

Use of third-party services is at your own risk and subject to their terms and policies.

11. Privacy

Your use of the Platform is also governed by our Privacy Policy.

By using the Platform, you acknowledge and agree to our Privacy Policy and the collection and use of information described therein.

12. Platform Availability

Fresh Cut Talent may modify, suspend, discontinue, or restrict access to any part of the Platform at any time.

We do not guarantee uninterrupted access, continuous availability, or error-free operation.

13. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRESH CUT TALENT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Fresh Cut Talent does not guarantee:

  • Uninterrupted service
  • Error-free functionality
  • Successful hiring outcomes
  • Availability of opportunities
  • Accuracy of user-generated content
  • Employer legitimacy
  • Candidate qualifications

Use of the Platform is at your own risk.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FRESH CUT TALENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO:

  • Use of the Platform
  • Hiring decisions
  • Employment relationships
  • User interactions
  • User-generated content
  • Service interruptions
  • Reliance on Platform content
  • Unauthorized access to data

In no event shall Fresh Cut Talent's total liability exceed the amount paid by the user to Fresh Cut Talent during the twelve (12) months preceding the claim.

15. Indemnification

You agree to indemnify, defend, and hold harmless Fresh Cut Talent and its owners, affiliates, employees, contractors, agents, and representatives from any claims, liabilities, damages, losses, costs, and expenses arising from:

  • Your use of the Platform
  • Your User Content
  • Your violation of these Terms
  • Your violation of any law or third-party rights

16. Termination

Fresh Cut Talent reserves the right to suspend, restrict, or terminate access to the Platform at any time, with or without notice, for any reason, including violations of these Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to conflict of law principles.

Any legal action arising from these Terms shall be brought exclusively in the state or federal courts located in Georgia.

18. Changes to These Terms

We may revise these Terms from time to time.

Updated Terms will be posted on this page with a revised Effective Date.

Continued use of the Platform after revised Terms are posted constitutes acceptance of the updated Terms.

Users who engage in harassment, discrimination, fraud, or conduct that undermines the integrity of the community may have their accounts suspended or terminated.
